No by-election for Batang Kali state seat — EC

PUTRAJAYA, Feb 22 — There will be no by-election to be held for the Batang Kali state seat in Selangor, the Election Commission (EC) announced today.

EC Secretary Datuk Ikmalrudin Ishak said they have received the letter of notification from the Selangor State Legislative Assembly Speaker Ng Suee Lim yesterday, regarding the unexpected vacancy of the Batang Kali seat after it was declared vacant in accordance with Article LXIX of the Selangor Constitution 1959.

He said based on Part Two, Chapter 5 Article LXX (5) of the Selangor Constitution 1959, the State Assembly Speaker has notified the EC that there was no need for the unexpected vacancy to be filled.

“Therefore, there will be no by-election to be held for the N07 Batang Kali seat in Selangor,” Ikmalrudin said in a statement.

On February 16, Ng announced the Batang Kali seat vacant effective January 28, after its state assemblyman Harumaini Omar failed to attend the State Assembly sittings for more than six months.

He said Harumaini was found to have been absent without permission from the Speaker throughout the sittings from November 23 to November 30, 2022, December 1 to December 2, 2022, and December 5 to December 6, 2022.

Ng added there were no records in the Selangor State Assembly Office and Speaker’s Office to show that the Parti Pejuang Tanah Air state assemblyman had applied for permission from the Speaker to be absent from the assembly for that period.
