MPSJ clarifies Development Service Charge By-law Draft

SHAH ALAM, FEB 9: The Subang Jaya Municipal Council (MPSJ) has organised a Workshop on Development Services By-laws Draft as an initiative to create development service charge for developers.
MPSJ Corporate and Strategic Management Department Deputy Director, Azfarizal Abdul Rashid said, MPSJ and other local authorities are directly exercising the provisions in the Roads, Drains and Buildings Act (Act 133).
“However, the provision is not sufficient and clear enough for implememntation.
“Therefore, this workshop is to create a single source of authority for MPSJ to implement the development service charge to developers who wish to carry-out development activities.
“Development Service Charge By-laws Draft is required for a more coordinated and regulated implementation,” he said in a statement.
Azfarizal said, the draft is consistent with the Act 133 itself, where local authorities can create By-laws to give more details to existing methods.
“This is to ensure that local authorities have legitimate powers besides preventing disputes and legal implications if administrative actions are taken.
“This is also to ensure non-compliance or default action can be enforced with legal actions and helps the local authorities in improving public infrastructures,” he said.
