KUALA LUMPUR, Aug 25 — A new concept, called the ‘silence implies consent after 28 days’, will be introduced by the government for obtaining the Certificate of Completion and Compliance (CCC) for completed buildings.
Malaysia Productivity Corporation (MPC) Director General, Datuk Abdul Latif Abu Seman said the construction industry highlighted that due to the Movement Control Order (MCO), 9,090 buildings are pending clearance as at May 7, 2020 (excluding Sabah and Sarawak) by local authorities and technical agencies on the CCC via MyMudah.
“With this improvement, we could create 65,000 job opportunities in the construction industry and support the economic recovery,” said Abdul Latif after presenting the recommendations at the Economic Action Council Meeting No. 19/2020 chaired by Prime Minister Tan Sri Muhyiddin Yassin.
The CCC is a certificate which provides final sign-off by principal submitting person on construction of a building. It is an assessment undertaken by industry professionals to ensure that the building has been made true to its original approved plans by local authority, safely constructed and that fit for occupation.
Malaysian Institute of Architects (PAM) president, Datuk Ezumi Harzani Ismail said, “The building industry supports this concept as it will cut down the bureaucratic paper works, as the completed buildings have been inspected by architects and engineers with all essential services connected and ready for occupation.”
From the preliminary discussions initiated by MPC with the industry and several technical agencies from federal and state level, the meeting today concurred with the recommendations for implementation.
The technical agencies will start the ball rolling on Sept 1 with the issuance of a memo outlining the ‘silence implies consent after 28 days’ concept to all the professionals, relevant professional boards and Local Authorities.
The concept will then be implemented with a clearance letter deemed to have been issued to the submitting person if the letter was not issued after 28 days, so that the principal submitting Person can issue the CCC thereafter.
The building is still subject to a final inspection that all conditions are met.
As it is a new concept, agencies such as Pemudah, National Water Services Commission (SPAN), Energy Commission, Tenaga Nasional Berhad, Indah Water Konsortium and other water authorities from states will continuously educate professionals and local authorities on the above concept for effective implementation on the ground.
