AG Department’s decision to delay EC judicial review doubtful

SHAH ALAM, NOV 11: “The decision by the Attorney General’s Chambers to delay the hearing for judicial review of Election Commission (EC) regarding re-delineation raises doubts,” said Dato’ Seri Mohamed Azmin Ali.
The Dato’ Menteri Besar said more surprisingly, the EC claimed that it will only be ready for the hearing next year.
“The State Government strongly opposes the Attorney General’s proposal because it would be meaningless for the review application to made next year.
“Especially as the EC is allowed to continue the local investigation process, then it means that any decision on that point will only be academic,” he said at the Selangor State Assembly on November 10.
Earlier, Bukit Gasing Assemblyman R Rajiv raised a motion urging the EC to withdraw the proposed re-delineation in Selangor.
At the same time, Mohamed Azmin defended his statement saying that there had been a proposal to nominate the Principal Private Secretary to the Prime Minister as EC Deputy Chairman prior to this.

“Reports said the proposal was withdrawn, meaning it had been proposed. If not, the term ‘withdrawn’ will not be used.
“Is there no independent person who can manage the EC? Do people want to be fooled again? Enough of being played by Umno’s leaders,” he said.
High Court Judge Datuk Hanipah Farikullah had previously agreed that the State Government file an application to suspend the local investigation by the EC, while awaiting the hearing.
Prior to this, the State Government challenged the re-delineation proposed by the EC that allegedly violated Article 113 (2) and Section 2 (c), 2 (d) of the Thirteenth Schedule of the Federal Constitution.
